Vero Beach Car Accident Lawyers
Vero Beach Car Accidents
Car accidents are responsible for thousands of injuries and deaths in Florida every year, despite the fact that the vast majority of these crashes are preventable. Regrettably, instead of driving with a reasonable amount of care, drivers engage in speeding, distracted driving, texting while driving, drunk driving, and other reckless or negligent behaviors, with disastrous results for the innocent victims of another’s negligent driving. The personal injurylawyers at Lulich Attorneys & Consultants know what it takes to help injured drivers, passengers and pedestrians recover compensation from a negligent or distracted driver. We fully understand Florida insurance laws and have helped countless automobile accident victims recover a fair amount of compensation to help them deal with their medical bills, lost wages and other legal damages. We can help you too.
Your Rights and Duties under Florida Car Insurance Laws
Florida law requires drivers to carry Personal Injury Protection (PIP) coverage, also known as no-fault insurance. If you are hurt in a car accident, you can file a PIP insurance claim regardless of who was at fault in the accident. PIP insurance covers 80% of your medical bills and replaces 60% of your lost income while you are disabled from working, up to a total of $10,000. However, unless you sought treatment for an emergency medical condition within 14 days of the accident, your coverage can be capped at only $2,500.
$2,500 is often too little in a serious accident, and even $10,000 may not cover all of your expenses if you are seriously injured. What’s more, by its own terms, PIP only covers a fraction of your medical bills and lost income. You are already suffering from your injuries. Is it fair that you should also suffer financially for an accident that wasn’t your fault?
If you are truly seriously injured, Florida law allows you to pursue a case against the negligent driver for the full amount of your medical costs and lost income, as well as compensation for your pain and suffering, loss of quality of life, emotional distress and other legal damages. In order to pursue a civil claim for negligence, you must be able to prove that you suffered one of the following:
- Significant and permanent loss of important body function
- Significant and permanent scarring or disfigurement
- Permanent injury within a reasonable degree of medical probability
You must be able to prove that your injuries meet the above legal definition of serious injury, as a threshold matter, in order to pursue your case. On top of that, you also have to be able to prove that the other driver was negligent in causing the accident, and that the driver’s negligence caused your injuries. Proving these elements of a car accident case requires experience and expertise. We have those qualities at Lulich Attorneys & Consultants. Our car accident lawyers how to negotiate effectively with the insurance company, as well as how to try your case in court if a fair settlement cannot be reached
